Civil Rules Relevant to Collection Lawsuits

In Washington, the rules of civil procedure for superior and district courts differ as to how a lawsuit is actually started, and this difference is the cause for a lot of confusion for consumers, volunteer legal aid clinics and lawyers lacking a solid understanding of the rules of civil procedure. As a result, I frequently receive phone calls and email inquiries from Washington consumers concerning default judgments that were entered against them. A default judgment can (and likely will) occur when the complaint is not answered within the time required by the civil rules.
